TERMS AND CONDITIONS OF SALE

 

1.     Definitions

 

The terms capitalized of the present Conditions of Sale and Terms have the following meaning:

 

-       “TCS” means the present terms and conditions of sale, viewable at the following link : http://shop.olympic.org/terms-conditions/

-       “IOC” means the International Olympic Committee, in Lausanne,

-       “Order” means the list of Products You have chosen and validated for purchase via the E-commerce Website.

-       “The Museum” or “We” means The Olympic Museum, a Foundation under Swiss law domiciled at Quai d’Ouchy 1, 1007 Lausanne.

-       “Privacy Policy” means The Museum’s privacy policy concerning the handling of the Client’s personal data, viewable at the following link: http://shop.olympic.org/en/home/privacy-policy

-       “Price” means the price of each Product, as indicated on the E-commerce Website.

-       “Product(s)” means one or several products put on sale by The Museum on the E-commerce Website.

-       “E-commerce Website means the Museum’s online selling platform the URL of which is http://shop.olympic.org.

-       “TCU” means the current version of the Terms and Conditions of Usage (TCU) of the Website, available at: http://www.olympic.org/legal-information/documents-reports-studies-publications

-       “User Account” means the account You are invited to create in order to purchase Products via the E-commerce Website.

-       “Website” means the International Olympic Committee’s website www.olympic.org through which the E-commerce Website is accessible.

-       “You” means yourself as a user of the E-commerce Website.

 

2.     Application of the TCS, Privacy Policy and TCU

 

You agree that the present TCS shall apply to any Order and any transaction concluded between You and The Museum though the E-commerce Website. You further agree that any use of Website, including the E-Commerce Website, is governed by the TCU, which are fully applicable in all matters not specifically addressed in the present TCS. In case of conflict between the TCS and TCU, the TCS shall prevail.

 

The Museum reserves the right to change any term of the present TCS, at any time and in its sole discretion. When we make changes, we will revise the "last updated" date at the top of the E-commerce Website. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of changes will constitute your acceptance of such changes. We encourage You to review the applicable terms whenever you visit the Website.

The version of the TCS applicable to any transaction concluded between You and The Museum is the version in force at the time of the Order.

 

3.     Purpose of the TCS

 

These TCS govern the terms and conditions according to which (i) The Museum agrees to sell to You one or more Products, and (ii) You agree to purchase one or more Products from The Museum. Orders may only be placed for personal and private purposes. No Order may be placed in the view of reselling the Products or for any other commercial or promotional purposes.

The TCS are considered to be accepted when You tick the “I have read and accepted the Terms and Conditions of Sale” box.

 

4.     Registration

 

You agree that Orders can only be placed by natural persons with the legal capacity under the laws of their country of residence to place an order on the E-commerce Website. If the laws or your country of residence do not allow You to place an Order, please do not use the E-commerce Website.

 

To place an Order on the E-commerce Website, You will need to register and create a User Account. When You register, You will create a user name (a registered email address) and password to access your User Account. You are responsible for maintaining the confidentiality of your user name, password and all User Account data. You may not share this information or your User Account with anyone else, and are solely responsible for all acts or omissions that occur under your User Account.

 

5.     Conclusion of sale agreements with the Museum

 

A sale agreement between You and The Museum is concluded and the benefits and risks of your Order shall pass to You, when You have paid the Price for the Order and The Museum has confirmed your Order by email on the address You provided in the ordering process.

 

You agree that the IOC is not a party to, and is not bound under any agreement entered into between The Museum and You through the placement of an Order on the E-commerce Website.

 

The Museum reserves the right, up until the Order is delivered, to cancel the Order without reason. The amount paid will be reimbursed to You as soon as possible.

 

6.     Price

 

The Prices are indicated in Swiss francs (CHF) and are inclusive of VAT for orders delivered in European Union Member States. However, Prices do not include delivery costs and any tax, duty or fee imposed pursuant to applicable custom regulations and local laws in the State of delivery.

 

The payment shall be made exclusively in Swiss francs (CHF). For clients whose local currency is not the Swiss francs, the conversion into their currency will be made on the day the Order is processed by the Payment Services Provider (“PSP”), DATATRANS.

 

For information purposes only, the Price may be mentioned in euros (€) or US dollars (US $).

For an Order delivered outside Switzerland, You acknowledge that Products may be subject to possible taxes and customs duties imposed at the time of delivery of the Product(s).

You also agree that such taxes and customs duties fall under your sole responsibility.

The Museum is not in a position to check and inform You of the amount of these taxes and customs duties. The Museum invites You to contact the competent authorities of the delivery country to ascertain such amounts.

 

7.     Product availability

 

The Museum accepts any Orders while stocks are available.

For information purposes only, the availability of each Product is indicated on the E-commerce Website.

Should a Product be unavailable, despite the information provided on the E-commerce Website, The Museum undertakes to cancel the Order and reimburse the sum paid as soon as possible.

 

8.     Payment

8.1 Visa Card

In recognition of VISA’s support for the Olympic Games, The Museum prefers card payments by VISA (credit, debit and prepaid) even if we also accept payments by Mastercard. For more information on how to obtain a VISA card, contact a VISA card issuer or visit the VISA web site: www.visaeurope.com.

 The payment is validated when the PSP confirms the transaction.

 Your bank details and/or payment card details are at no time known to and/or stored by The Museum.

 The Museum invites You to read the bank data processing conditions by clicking on the following link: www.datatrans.ch/.

 The Museum will be paid the amount of the Order as soon as the Order validation is recorded.

 

8.2 Prepayment

You can choose to pay by wire transfer.

 Once your Order is confirmed, the payment information will be mentioned on the invoice.

 The Museum invites  you to mention the number of the Order on the description of the wire transfer.

The payment is validated  when the Museum has obtained  confirmation from its bank that the money has been transferred to the Museum’s bank account.


9.     Personal data

 

To create a User Account and place an Order, You will be invited to provide the following personal information under your full and sole responsibility:

  • Email address
  • Family and given names
  • Complete address (street name and number)
  • City/town
  • Post code
  • Telephone number

Should there be an error in your contact details, The Museum shall not be held responsible for any consequences, in particular inability to deliver the Product(s).

 

The data indicated by You, as recorded by the Museum’s IT system, may be used by the Museum as evidence of all the transactions between You and the Museum.

 

The Museum undertakes to handle your personal data in compliance with the Swiss Federal legislation on data protection and in the respect of the Privacy Policy.

 

By placing an Order, You agree that your personal data will be processed by the Museum in accordance with the Museum’s Privacy Policy, which can be viewed at http://shop.olympic.org/en/home/privacy-policy.

 

 

10.  Dispatch and delivery

 

The standard expected delivery time is three to four working days. This time may be longer for delivery outside Europe.

 

You are invited to consult your User Account on shop.olympic.org, “My orders” to obtain the tracking number of the order and follow the delivery status on: www.ups.com.

 

While the Museum will use its best effort to ensure speedy delivery of, the delivery time indicated above is indicative and any delay in the delivery does not entitle You to cancel the Order, or claim damages or compensation.

 

11.  Receipt of the Order – Your Obligations

 

Upon receipt of the Order, You are requested to immediately check the condition of the Product(s) delivered.

 

In the event that defects are noted upon delivery, You must keep the parcel and the Product(s) concerned, in its/their present condition, and immediately provide the transport company with your reservations and comments concerning the condition of the Product(s) upon delivery, and keep a copy of the delivery slip with such comments.

 

If a Product should prove to be defective or damaged upon delivery, You may be eligible for reimbursement in accordance with article 12.2 below.

 

12.  Your Rights 

 

12.1  General Right to Return Products

 

You have fourteen calendar days upon receipt of the Product(s) to return it/them, without reason and without penalty, to the Museum as per article 13 below.

 

Such a return shall be requested through your User Account by selecting Your Order (comments can be written in French or English only).

 

12.2  Rights in case of manufacturing defect or damaged Products owing to transport

 

Should there be any defect due to the manufacturing of the Product(s) or any damage due to transport, You may return, by regular mail, the relevant Product(s) and request reimbursement of the Price and delivery costs, subject to the following cumulative conditions:

 

1.       The defect/damage must be declared to the Museum within three days of its discovery, given that You must examine the Product(s) carefully upon its/their receipt. For defect and damage due to transport, no claims will be accepted after the three days following delivery of the Product(s).

 

2.       All claims must be made through your User Account by selecting your Order (comments can be written in French or English only).

 

For defect or damage observed upon delivery or due to transport, You must keep a copy of the delivery slip and the comments made on it concerning the damages noted. Such a document shall be provided to the Museum upon its request.

 

3.       The defective/damaged Product(s) must be kept in its/their current state and returned to the Museum in its original packaging as per Article 13 below.

 

You may not request an exchange or repair of the Product(s).

 

13. Procedure for Returning Products

 

The procedure for returning Products is as follows:


You may ask the return of the Product through your User Account by selecting your Order.
  1. A return code (RMA code) to mention on the parcel of the returned Product(s) and on any correspondence with the Museum.
  2. The address where the returned Products must be sent.
  3. Products being returned must be sent back in their original packaging, by regular mail, in accordance with The Museum’s instructions.

  4. The Museum will examine the returned Product(s) to determine, at its sole discretion, if the conditions for reimbursement are fulfilled.
  5. The Museum invites You to carefully keep the receipt issued by the transport company to You upon returning such Product(s). In the event that a parcel is lost, no reimbursement can be made without this proof of dispatch.

 

You are invited to consult your User Account, “My orders” to follow the status of your returned Product(s).

 

 

14. Reimbursement

 

If The Museum determines, at its sole discretion, that the conditions for reimbursement are fulfilled, the Museum will reimburse You the Price of the Product(s) in question as well as the transport costs linked to such Product(s) as soon as possible. If the conditions are not fulfilled, the Museum will return You the Product(s) at its expenses.

 

15. Guarantee and Exclusion of Liability

 

The provisions of Swiss Law (Code of Obligations) concerning the guarantee shall apply in all matters not addressed in the present TCS.

It is your responsibility to verify that the laws of your country of residence authorize You to place an Order on the E-commerce Website. The Museum will not be held liable, should a Product not comply with the legislation of the country to which it is delivered.

 

The Museum may not be held liable for any loss or damage you may suffer as a result of the placement of an Order, except in the event of damages caused by intention or gross negligence.

 

16. Applicable Law and Jurisdiction

 

These TCS are governed by and construed in accordance with the laws of Switzerland, and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

 

Any dispute or claim arising out of or in connection with these TCS, shall be subject to the exclusive jurisdiction of the competent courts in Lausanne (Switzerland), subject to appeal to the Federal Tribunal.
